Misstatement of Information


A misstatement of information is a misstatement to a question asked during the application process that is so important that, had the truth been known, the insurance company would not have issued the policy or would have issued it with a higher premium. Discovery of a misrepresentation during the contestable period (usually two years) may result in the policy being voided. After the contestable period, the company cannot void or amend the policy without proving fraud. See also Material, and Material Misrepresentation.
